This Wednesday, March 15, 2017, the Council of State rejected the appeal in cassation of the specialist in thinness: the experts believe that the disciplinary chamber of the order of physicians had “neither committed an error of law nor distorted the facts before it ”.
Jean-Michel Cohen therefore remains banned from exercising for one year and is also ordered to pay € 2,000 to the National Council of the Order of Physicians for the costs incurred.
Knowing how to lose weight, a site deemed “advertising”
The problem ? A matter of deontology. The national order of physicians has in fact judged that the Savoir leanness site has “an advertising character”: on this platform (managed by Jean-Michel Cohen’s team and published by the company Anxa, to which the nutritionist is linked) , you can take out a subscription for losing weight sustainably and receive advice from the star doctor.
However, the public health code stipulates, among other things, that when a doctor “participates in an action to inform the public of an educational and health nature”, he must “refrain (…) from any advertising attitude, either personal, either in favor of the organizations in which he works (…), or in favor of a cause which is not of general interest ”.
In addition, article 20 of the code of medical ethics stipulates that “the doctor must see to the use which is made of his name, his capacity or his declarations. He must not tolerate the public or private organizations in which he practices or to which he lends his assistance using his name or professional activity for advertising purposes ”.
