Professor Henri Joyeux was struck off the Order for “his alarmist speech on vaccines”. In 2015, 24 other practitioners underwent this sanction which can be reviewed after 3 years.
Prosecuted for two offenses by his peers, Professor Henri Joyeux, cancer surgeon retired since 2014, was removed from the Order of Physicians. The institution reproaches him in particular “his alarmist speech on vaccines”, according to the Medical Press Agency (APM). The doctor has one month to appeal.
This sanction applicable from 1er December implies a definitive ban on exercising one’s profession. An isolated case ? Not really. The former Montpellier practitioner is not the only one to have suffered the wrath of the CNOM.
According to our information, 24 radiations were pronounced in 2015 by the disciplinary chambers of first instance of the Order of Physicians. A figure in clear increase since there were only 13 in 2014.
Various and varied patterns
These decisions remain very marginal since they represent only 2% of the sanctions pronounced by the Order in 2015. In addition, these judgments can be appealed against.
But in 2015, we already know that many of these radiations will be permanent since 14 doctors out of 24 have decided not to appeal. In addition, others were confirmed during this second meeting with ordinal justice.
These doctors who are banned from practice are for various reasons. And the seriousness of the faults is more or less important. They range from certificates of convenience, to non-AMM prescriptions, through cheating with the CPAM and disputes with taxes.
There are also doctors who have practiced during a suspension, and more seriously, 9 were struck off for moral matters (acts of sexual connotation or assaults of this nature). Worse, 1 radiation concerns an attempted murder.
The Joyeux affair for dangerous remarks towards the population therefore remains an exception. Convicted doctors do not take these judgments lightly. Most of them go to hearings, especially when it comes to an appeal. This was the case for Prof. Philippe Even and Bernard Debré and Dr. Pierre Dukan. Another proof of the doctors’ determination, some do not hesitate to exhaust all possible remedies. Even the most unknown to the general public.
The definitive cancellation does not exist
This is the case with disability relief. At the end of three years as from the decision of radiation, the doctor can make the request. It is a procedure which allows the doctor to return to the disciplinary chamber for his situation to be re-examined. If he wants to win his case, he will also have to show that, during this period without exercise, he continued to train and that he has not lost all of his achievements. A professional plan and a good understanding of the sanction will also be valuable points for the practitioner. Finally, in the event of further failure, the doctor can always try his luck again after three years. This as many times as he wishes.
