In a report titled “The examination of management, operation and missions of Oniam” which has just been handed over to Marisol Touraine, Minister of Social Affairs and Health, the Court of Auditors calls into question the mission of the National Office for Compensation for Medical Accidents (Oniam). In this report that The Parisianwas able to consult, the Court of Auditors points to the multiple failures of this health agency created in 2002 to facilitate compensation for victims of medical accidents (such as the victims of the Mediator, for example).
This report denounces in particular:
• Too long processing times for files, which can reach “between 3 and 4 years”
• The rate of rejection of cases (conciliation and compensation commissions reject 3 out of 4) and unexplained refusals
• Compensation less than that granted by judges when victims choose the legal route.
The Sages also point the finger at the mismanagement of public funds by the organization. The latter is supposed to recover the funds advanced from the laboratories concerned by the medical accidents. However, in total, “without counting the cases with summons, the amount to be recovered amounts to nearly 30 million euros out of the 49.5 million advanced” indicates the Court of Auditors.
