More than a hundred patients victims of the change of formula Levothyrox, a drug that treats thyroid disorders, have filed a claim for compensation with the Lyon district court. Assisted by Me Christophe Lèguevaques, they opted for civil proceedings, asking for compensation of 10,000 euros per person (5,000 € of damage resulting from lack of information and 5,000 € from loss of anxiety) at the Merck laboratory, which markets Levothyrox.
“The laboratory was fully aware of the risks”
The change in the formulation of the drug should have been accompanied, according to the lawyer, by a special warning to reassure and prevent any undesirable side effects.
“According to the medical literature and bioequivalence tests, Merck laboratories were fully aware of the risks and knew that 5 to 7% of patients would have to face more or less serious disorders”, considers the lawyer
The first hearing will take place on December 18 at the Lyon court. The court will then have to rule on the merits of the request.
