Remember: in January 2019, the Regional Health Agency (ARS) Center-Val de Loire announced the death of six people in a nursing home in Loiret – four residents and two members of staff.
Although only one death was officially attributed to the influenza virus, the ARS then explained that, for the six deaths, “there are elements which probably make one think of a flu syndrome but we are awaiting the results. of examinations ”.
Continuation of the case: this Friday April 12, 2019, the lawyer for the son of Michèle Desroches (85), the resident of Ephad who died of the flu on January 26, 2019, filed an action for compensation at the administrative court of Orléans. The complainant is claiming 100,000 euros from Ugecam, the company which manages the accommodation establishment for dependent elderly people (Ehpad) concerned.
“Hospitalized only 48 hours before her death”
“On January 9, her condition was worrying and she was not hospitalized until January 24. We consider that there is a fault of service because she could have gained a few years of life if she had been hospitalized earlier ”, underlined Me Régnier, lawyer of Benoît Desroches, the son of the victim.
The latter points in particular to an absence of vaccination: “she was not vaccinated. It had been in previous years but not this year. She had been ill for three weeks and was not hospitalized until 48 hours before her death. If her case had been taken in time, maybe she would still be here today ”.
In January, Ugecam had indicated that three of the deceased residents had been vaccinated, “the fourth not having wished to be vaccinated”. To be continued…
