On June 24, the Senate removed burnout from the list of occupational diseases. Marisol Touraine pleaded this Tuesday for its reintroduction.
Burn – out is back in the spotlight. The Minister of Health, Marisol Touraine, wished, this Tuesday, on France Inter, that the burnout syndrome, withdrawn by the Senate on June 24 from the list of occupational diseases, be “reintroduced into law” within the framework of the social dialogue project. “The Senate ruled out this possibility (…). Burn-out, a syndrome of professional exhaustion, is a very important issue. Enrolling it in law as an occupational disease will require work, recognition procedures, etc. ”, the Minister said.
A complexity of the pathology
The deputies had adopted a socialist amendment providing that “mental illnesses can be recognized as illnesses of occupational origin” in the same way as musculoskeletal disorders or asbestos-related illnesses.
These pathologies were to be taken into account via the complementary system of recognition of occupational diseases, the inclusion in the table of occupational diseases not being adapted to the specificity and complexity of these pathologies, according to the presentation of reasons for government amendment.
Today, a few dozen cases per year obtain legal redress. To be recognized, the disease must result in a permanent disability of more than 25% and that a “direct and essential” link with work be demonstrated, according to the provisions in force.
