Tightening of the ecological penalty
The scale of the ecological penalty is further tightened at 1er January 2022. The trigger threshold is now set at 128 g / km of CO2 (against 133 g / km in 2021). The maximum amount of the tax, which peaked at 30,000 euros in 2021, amounts to 40,000 euros in 2022 for the most polluting vehicles (> 223 g / km of CO2). Note that the total cost is now capped at 50% of the vehicle price including VAT, for all brackets.

Arrival of the weight penalty
The arrival of the weight penalty is perhaps the biggest novelty of this year 2022. This tax applies to vehicles weighing more than 1,800 kg. This is the “mass in running order”. It includes a 75 kg driver, in accordance with European regulations. A unit price of 10 euros per excess kilo should then be applied.
The following are exempted: electric or hydrogen cars, plug-in hybrids with at least 50 kilometers of electric range in town, vehicles accessible to people with reduced mobility, as well as light commercial vehicles (LCV) of less than 3.5 t dedicated to the transport of goods. A reduction of 200 kg per child is also provided for large families, and another of 400 kg for companies and legal entities wishing to acquire a vehicle with at least eight seats. The accumulation of the weight tax and the ecological penalty cannot exceed a ceiling of 40,000 euros, or 50% of the new price for the cheapest vehicles… while waiting to go to 50,000 euros in 2023.
Ecological bonus soon to be planed
Due to the impact of the pandemic, but also the shortage of semiconductors on the industry and the automotive market, the Government has postponed the introduction of the 2022 ecological bonus by six months. The 2021 scale will therefore remain in force. until June 30. At 1er July, the amount of subsidies will be reduced by 1,000 euros. Currently, the purchase of a 100% electric vehicle for less than 45,000 euros by an individual in metropolitan France is supported by a bonus equivalent to 27% of the purchase price, capped at 6,000 euros.
For a model whose amount is between 45,000 and 60,000 euros, the premium is 2,000 euros. Beyond that, only hydrogen cars retain a bonus of 2,000 euros. Plug-in hybrids of less than 50,000 euros and capable of traveling at least 50 kilometers on electricity alone (WLTP cycle) are entitled to a bonus of 1,000 euros. Given the delivery times, which currently amount to several months, it is better to complete your purchase as soon as possible. in order to hope to benefit from the most advantageous aid, even if a period of three months remains foreseen to be delivered while benefiting from the most favorable bonus in the event of an order just before the 1ster July.
Less advantageous conversion premium
Last minute surprise, the scale of the 2021 conversion bonus is not extended until June 30, 2022. Thus, since the 1er January 2022, only thermal vehicles emitting less than 127 g / km of CO2 (instead of 132 g / km in 2021) will be eligible. The aid can go up to 5,000 euros for the purchase of an electric or plug-in hybrid car depending on the tax income per share.
Increase in toll prices
Like every 1er February, toll prices will increase. The average increase should be 2%, after an increase of 0.44% at the start of 2021. The ASF network – the largest in France with its 2,627 km of sections – should be the one where the increase will be the highest: + 2.19%. The APRR network, the second largest concession with 1,812 km of track, plans to increase prices by 2.05%.
More active radars
The Government will not install more radars in 2022, but will considerably renew and modernize its fleet. The State wishes to have 4,500 active systems in the territory. Next year, motorists will see new urban radars unloading. There will be 100 active in 500 cabins. The number of autonomous radars will also increase to reach a fleet of 400 devices. Radar cars entrusted to private companies will multiply: 400 will soon crisscross the roads. The only good news: the ticketing at the entrance of EPZs for the most polluting vehicles will not be active anytime soon, because ad-hoc regulations do not exist! Finally, the Government is still counting on 714 million euros in revenue. A slightly better score than in 2021.
Mountain Law since 1er November 2021
Under the Mountain Law, winter equipment for vehicles (chains, socks and winter or all-season tires) has become compulsory in 34 of the 48 French departments with mountainous areas. Motorists must be equipped during the winter period, which runs from 1er November to March 31. If the Government is tolerant this year, from autumn 2022 the sanctions will fall. Some prefects have already chosen to issue a ticket!

Automatic cruise control soon to be mandatory
As of July 6, 2022, the presence of an intelligent speed adaptation device (AIV or ISA in English for intelligent speed assistance) on board all new vehicles approved for the European Union (VL, LCV and PL ) will be required. The other new vehicles will have to be equipped from 2024 last deadline. Note that, to know the maximum authorized speed, the AIV can be based on the cartographic data of the vehicle’s navigation system and / or on the latter’s cameras making it possible to recognize the traffic signs. The device can take several forms, including that of an autonomous speed limiter, but can be deactivated.
What about the pros?
> TVS
Since the 1er January, the tax on company vehicles (TVS) has disappeared of the Tax Code and has been divided into two annual taxes due in January 2023. One relates to carbon dioxide emissions (CO2), the other to air pollutant emissions. Companies are now based on a linear scale (and no longer on a system of slices) where each gram of CO2, from 21 to 269 g / km, is associated with an amount, as for the ecological penalty. For emissions greater than 269 g / km, the rate is equal to the product between emissions and 29 euros per gram per kilometer.
> Minimum wage
A revaluation of the minimum growth wage of 0.9% has been effective since 1er January. From then on, the gross hourly minimum wage rose to 10.57 euros (against 10.48 euros until then) and the gross monthly minimum wage (for 35 hours per week) to 1,603.12 euros (against 1,589.47 euros until then). . This new increase, which closely follows the last one in October 2021, thus confirms an evolution of the minimum wage of + 3.1% over one year, or 48 euros gross per additional month.
