An amendment aimed at making alcohol advertising more flexible is being considered by the National Assembly. Claude Evin vigorously denounces it.
Will alcohol advertising be relaxed? In any case, this is what fears Claude Evin, author of the law that bears his name, which launches the alert in the columns of the Parisian this morning. Marisol Touraine spoke during the day to support the former minister.
“Limitless advertising”
The current director of ARS Ile-de-France denounces an amendment to the Macron bill which aims to modify the law on alcohol advertising. This amendment, proposed by the senator and former winegrower Gérard César (Les Républicains, ex-UMP), aims to distinguish between information and advertising on wine. It is examined this Monday at the Assembly.
“This amendment – which seems technical – will de facto free up the possibility of advertising in favor of alcohol, and this, almost without limit”, deplores the former minister who anticipates “the end of the Evin law, adopted here twenty five years “. Thus, according to Claude Evin, it will be impossible to attack a company for advertising on alcohol, if the amendment is voted.
“An association (for example) which will challenge an advertisement for alcohol in court will, to succeed, both prove that the person promoting (even indirectly or subtly) the product has an interest in it, but also that this ‘communication operation’ is ‘likely to be perceived as an act of promotion by a consumer of average attention’. Let’s move on to the fact that this last sentence doesn’t mean anything. In fact, meeting these two criteria will be impossible! “, He explains to the Parisian.
The opposing government
Quoted by AFP, the Minister of Health Marisol Touraine opposed this amendment and called “not to change the law”. She expressed her “misunderstanding” and “concern” about this amendment. As for the government spokesperson and Minister of Agriculture Stéphane Le Foll, he reaffirmed his attachment to viticulture, but spoke in favor of the status quo on the law.
However, such an amendment was already voted on last March, during the health bill. Deposed by the Socialist deputy Denys Robiliard, Amendment N ° AS1207 proposes neither more nor less to redefine the notion of advertising in order to fill the “void” left by the Evin law. If this amendment were confirmed during the parliamentary shuttle, alcohol advertising would be reduced to “an act of promotion carried out in favor of a product or service, relating to the activity of a person having an interest in promotion of said product or service, and likely to be perceived as an act of promotion by a consumer of average attention ”. Like an air of déjà vu …
