After several months of discussions, ISNI denounces the proposal to reform the working time of interns as proposed to date by the Ministry of Health.
Indeed, according to these interns, following the sanctioning procedure initiated by the European Commission against France and the discussions that followed with the interns, Marisol Touraine decided not to take into account either the proposals from residents, nor from European law.

The Commission, in its reasoned opinion last March, very clearly indicated that France “does not take into account all the hours actually worked (…) while the directive requires that (the periods of overtime and the hours of lessons) be considered as working time ”.
But despite this warning launched by Brussels, the text proposed by the Ministry of Health today “ does not count as working time all the service obligations of interns. In addition to the fact that this proposal is illegal, it risks having a serious impact on the quality of the training of future health professionals. “, deplores the ISNI.
In addition, for the InterSyndicat, “ this text does not take into account the status of on-call duty for interns, for which no precise count can be made, unlike what is done for hospital practitioners. The ministry thus knowingly conceals the reality of the working time carried out by interns and therefore does not comply with the 48 hours per week set by the European directive (2003/88 / EC) ”, he criticizes.
As a reminder, according to a survey conducted by ISNI in 2012, an intern works an average of 60 hours per week. Other studies indicate that more than 65% of interns on hospital placements work more than 50 hours per week. Finally, in some extreme cases, interns can even do up to 90 hours per week for an emergency or surgery internship, for example.
The interns’ proposals
However, by massively signing the “Working time” petition launched by their representatives (ISNI, FNSIP-BM, SNIO and SNJMG), the ISNI reminds the government that the interns have shown their determination to bring their proposals to reform their working time. job.
And the latter are very clear as to the compliance of French law concerning the working time of interns.
Among them, the passage from 11 to 10 half-days of weekly work from Monday morning to Friday evening, the sanctification of the 2 half-days of training counted as working time, or the remuneration of any additional half-day of work. .
Finally, these interns plead for a review of the status of the operational on-call for interns, but also “ for the possibility of sanctions against health establishments that do not respect the rights of residents ”.
And finally, these interns warn the minister: “ ISNI, in consultation with representatives of interns in pharmacy and dentistry, reserves the right to take any action necessary to make the Minister of Health listen to reason, ”the press release concluded.
