An emergency referral suspended for 48 hours
To begin with, Me Jean Paillot, their lawyer, confirmed Wednesday to Agence France Presse (AFP) that he was going to file, again, an interim relief before the administrative court of Châlons-en-Champagne (Marne) “if the University Hospital of Reims announces the killing of Vincent Lambert ”. It will aim to suspend the decision rendered by Dr. Daniela Simon, head of the medical team, for at most 48 hours.
Indeed, this jurisdiction should still follow, in the end, the decision of the Council of State, the highest administrative legal body, which has already ruled in favor of stopping Vincent Lambert’s care. An opinion confirmed in June 2015 by the European Court of Human Rights (ECHR).
End-of-life protocol will begin, despite complaints
In addition, the parents of Vincent Lambert announced that they would file three complaints. Two against Dr Daniela Simon (in charge of their son) and the hospital for “attempted murder”. The Reims University Hospital, as well as the caregivers, received the support of the Order of Physicians a few days ago.
The last, for “false testimony, falsehood and use of falsehood” targets Rachel Lambert, the wife of the patient whose condition has worsened in recent years (swallowing disorders …). Nevertheless, the procedure for stopping treatment can begin without waiting for these criminal trials.
