- Negotiations will take place to extend the right to be forgotten to other pathologies.
- If successful, people with chronic conditions could benefit.
Ten years of combat, and a victory. The association RoseUp has long campaigned to facilitate access to credit for people who have been affected by cancer in the past. Their fight bore fruit: Wednesday, June 1, the right to be forgotten is reduced and goes to five years, against ten previously.
The end of the consideration of age
“The right to be forgotten results in the absence of an obligation to declare a pathology to the insurer“, recalls the Ministry of Solidarity and Health in a communicated. Until now, its duration varied according to the age of the person at the time of diagnosis: before the age of 21, the right to be forgotten applied five years after the end of treatment, and ten years after for people over 21. years at the time of diagnosis. From June 1, the right to be forgotten increases to five years for all patients, regardless of their age and type of cancer. This reform also concerns hepatitis C.
The objective of this legislative change is to facilitate access to bank loans for people who have been sick in the past. “This bill brings major advances for loan applicants in terms of borrower insurance in general and in the specific case of borrowers presenting an aggravated health risk., says the Ministry of Health. For those concerned, this is a major step forward. “Today, when you have been diagnosed with cancer, it is very difficult to borrow moneyexplains Isabelle Huet, general manager of the RoseUp association, to top Health. Either we refuse to insure you, or we impose very high premiums on you. You then pay a lot of money, for a very bad coverage.”
The removal of the medical questionnaire
This law allows another advance for people who have been sick: the medical questionnaire will no longer be necessary. This document, requested by insurers, requires people wishing to take out borrower insurance to provide information on their state of health. The answers are used by organizations to determine if they agree to cover the person and under what conditions. From June 1, “the transmission to the insurer of any information relating to the state of health of the insured or of a health examination” is no longer mandatory for “loans whose insured portion per person is less than 200,000 euros and whose maturity occurs before the insured’s 60th birthday”.
