A few days ago, the Minister of Health announced that the old formula of Levothyrox, a drug that treats thyroid disorders, would be available on medical prescription, in a fortnight, “so that those who ask for it can take it” said the minister.
The announcement was made following the Minister’s meeting with a patients’ association. But the latter nonetheless remain victims of adverse effects since the new formula was put on the market last March. So a certain number of them turned to a Toulouse lawyer who is launching a collective action in order to have the prejudice of patients recognized by the courts.
A lump sum compensation of 10,000 euros
According to this lawyer, the patients did not receive the information which would have been necessary to inform them of the risks of the change of formula, “the law has been violated”. He therefore launches this group action to:
– Request compensation from the Merck Laboratory because of the damage resulting from the lack of information on the new formula of Levothyrox and the side effects that may result from it;
– To assert a prejudice of anxiety caused by the stress generated by this situation. In the presence of a vital drug that made them sick, the sick had no alternative to treatment.
The court will be asked for a lump sum indemnity for each claimant of € 10,000 (€ 5,000 for the damage resulting from the lack of information and € 5,000 for the loss of anxiety).
