Monday, it’s over. E-cigarette users are having their last day of vaping at the office this Friday. From 1er October, the decree governing its conditions of use comes into effect. It will then no longer be possible to vape in most closed public places.
The use of e-cigarettes will in fact be prohibited “in schools and establishments intended for the reception, training and accommodation of minors, in closed means of public transport as well as in places of closed and covered work for collective use ”.
No ban in bars and on station platforms
Concretely, the ban concerns offices, schools, leisure centers or sports clubs, whether in buildings or outside. It will also be prohibited to vape on a train, plane, bus or in the corridors of the metro.
But, unlike conventional cigarettes, the text leaves the freedom to vape on the platform of a station outside, even if the platform is covered, or under a bus shelter. Places open to the public, such as bars or restaurants, are also not affected by the ban. Waiters, hospital workers or shop sellers, unlike office workers, may for example smoke at work.
On the other hand, the internal regulations of the establishments prevail over the law, if however these are more strict. Thus, restaurant owners can completely prohibit the use of e-cigarettes in their rooms.
Money goes up in smoke
The text also provides for an obligation to display the ban on vaping for all managers of establishments where the ban applies. In the event of a breach, they are liable to a fine of 3e category, that is to say at 450 euros.
Users who do not respect it will also face a hefty fine. They will be sanctioned in category 2, and will have to relinquish 150 euros.
