Thanks to a decree published in the Official Journal, PACS couples and cohabiting partners will have the same rights as spouses in the event of death at work.
No more difference between PACS or cohabiting couples and those who are married, in the event of death linked to an accident at work or an occupational disease. According to a decree published this Saturday in the Official Journal, it is now possible for the widower or widower to benefit from a life annuity in the event of premature death. Previously, this benefit was simply reserved for spouses.
In fact, this decree is the application in the Social Security code of the proposals put in place by the Social Security financing law passed in 2012. This is a major step forward, since it makes it possible to align the rights of PACS couples and cohabiting partners with those of spouses.
40% of the deceased’s salary
Asked by theAFP, Arnaud de Broca, secretary of the National Federation of Accidents at Work and the Handicapped (Fnath), seems satisfied for all couples who “sometimes find themselves in extremely complicated, precarious situations” following a death. Indeed, it is not uncommon for the spouse to be confronted with certain financial problems. This alignment will therefore result in compensation paid to the beneficiary.
This compensation should amount to 40% of the salary of the deceased. It will be paid until the death of the beneficiary. An annuity is also provided for children up to their twenties.
A welcome decision, since since its establishment in 1999, PACS couples have continued to increase (with a peak in 2010 and nearly 205,000 contracts signed) according to figures from INSEE. The partners would be nearly 5 million on the whole of the territory.
