A new complaint was filed last Friday against the HPV vaccine Gardasil for investigating judges to investigate again its possible adverse effects.
Despite a reassuring recent study and a first classification without follow-up in this case, the opponents of the Gardasil vaccine do not disarm. A new complaint was indeed filed last Friday against the anti-HPV vaccine from Sanofi Pasteur MSD, announced Me Jean-Christophe Coubris. The lawyer who defends Marie-Océane Bourguignon again wants investigating judges to investigate once again this vaccine against the cervix and its possible adverse effects.
A first unfavorable court decision
In this story, the Paris prosecutor’s office, seized by the first complaints since 2013, has therefore already closed a first preliminary investigation at the end of October 2015, considering that there was no direct link between the injection of the vaccine and the diseases denounced by some fifty complainants.
The new complaint, with the constitution of civil party, should thus allow the opening of a judicial information to the public health pole of Paris. “It appears essential that an investigating judge, provided with significant investigative powers, be seized”, thinks Me Jean-Christophe Coubris in comments reported by Agence France Presse (AFP).
The genetic vulnerability hypothesis
As a reminder, her client is a young woman from Landes who argues that “two months after two injections in 2010, she presented the first signs of acute disseminated encephalomyelitis, resulting in particular in a temporary loss of sight and the use of legs, ”explains his lawyer.
She accuses Sanofi Pasteur MSD “of not informing the user of the vaccine of the inflammatory risks of the central nervous system when these risks have been identified since 2009”, he continues.
Marie-Océane Bourguignon’s first complaint was in fact based on two expert reports which concluded that Gardasil could have played a role in her condition, but that genetic causes could not be ruled out either.
