He had been scamming Social Security since 2009: a dental surgeon practicing in Garches (92) was sentenced this Friday, July 7, 2017 to a 2-year prison sentence by the Nanterre Criminal Court. This decision is accompanied by a 3-year probation, an obligation to compensate the civil parties, a ban on practicing his professional activity and a fine of €15,000.
If the penalty (for fraud, money laundering and forgery and use of forgery) may seem heavy, the scam was colossal. Between 2009 and 2013, this 57-year-old health professional greatly overbilled his medical acts, even billed Social Security for non-existent medical acts – total amount of the fraud: 2.3 million euros. The Primary Health Insurance Funds (CPAM) concerned are located in particular in the Paris region, in the Loiret, in the Alpes-Maritimes, in Ille-et-Vilaine and in Vendée.
A fraud of 2.3 million euros
The practitioner explained to the court that he had been the victim of “blackmail” by certain patients who, having understood the maneuver, demanded a share of the profits. “At any time, he could put an end to these facts by filing a complaint” had however estimated the prosecutor, during the first hearing which took place on May 19, 2017.
The 17 other defendants, accused of complicity and concealment for having provided the dentist-fraudster with vital cards and/or having cashed checks, received sentences ranging from 4 months suspended to 30 months firm. The lawyer for the main defendant, for his part, has already announced that this decision will be appealed.
