The right to forget becomes a reality for former cancer patients thanks to the publication in the Official Journal of 2 decrees governing this measure. “They come to make applicable the law passed a year ago already”, rejoices Céline Lis-Raoux, founder of Rose magazine, a biannual dedicated to women with cancer.
For the Rose association, it is the culmination of a battle that lasted 3 years. From today, people who have been diagnosed with cancer or hepatitis C will be able to borrow from banks without declaring their illness at the end of a period of ten or five years after the end of the treatments. .
Thanks to this device, they will no longer pay extra premiums, often colossal, to their borrower insurance.
For certain cancers, specified in a reference grid, these deadlines may be shorter. “Research is advancing much faster than society. Today, doctors say that cancer is cured. It is therefore legitimate that we can borrow like everyone else since we no longer present any aggravated health risks, ”notes Céline Lis-Raoux.
Decisive breakthroughs
Concretely, these two decrees formalize the information given to insurers and possible borrowers. An essential tool because 6 months after the adoption of the right to be forgotten, the association realized that the site of the AREAS convention (insure and borrow with an aggravated health risk) was not available. day. “It indicated that the right to be forgotten was expressed within the limit of 320,000 euros. It is not at all in the spirit of the law and could mislead borrowers, ”explains the founder of Rose magazine.
Thus, these decrees clearly stipulate that the right to be forgotten is total and that former patients can borrow the sum they need. The prudential control and resolution authority (ACPR) will be responsible for monitoring compliance with the “right to be forgotten.” The device “brings hope and progress for people presenting or having presented an aggravated health risk”, commented Marisol Touraine.
Another piece of news delighted Céline Lis-Raoux. As of March 1, 2017, new borrowers will be able to terminate their creditor insurance every year. For credits already in progress, the law will come into force in January 2018. “This law was not designed for former patients, but it is wonderful news.
