Justice had decided yesterday concerning the cessation of care administered to the one-year-old girl, still in an artificial coma. The court had, against the opinion of the doctors, ordered the continuation of treatment in summary proceedings. “It’s a victory for the right to life against what would have been a death sentence for little Marwa. Despite the irreversible state and loss of autonomy in which one can find oneself, nothing justifies the cessation of care as long as there is hope”, welcomed the family lawyer, Samia Maktouf, whose the remarks are reported by AFP.
This Thursday, the management of the AP-HM for its part let it be known that it “shares the pain of the family in the face of this dramatic situation” and “wants to support the medical team and the nursing staff in this difficult situation. and unprecedented,” reports AFP. But the hospital nevertheless decided to seize the Council of State, “taking into account the consequences and the general scope of the court’s decision”.
Doubts about the pain felt
In November 2016, doctors at La Timone hospital (Marseille) decided, after a long procedure, to stop treatment and disconnect the breathing apparatus that keeps the little girl alive, suffering from irreversible lesions. . But Marwa’s parents had asked that the doctors continue the treatment. “We must give him the chance to live,” said the girl’s father, Mohamed Bouchenafa, from Nice, before the Marseille administrative court. “When I look at her, you see that she wants to live. It is not a child who wants to leave, ”he continued.
As a reminder, the parents, who share their fight on Facebook, had seized the administrative justice in summary, and the judges had ordered an expertise on the state of Marwa, before deciding. At the beginning of January, she concluded with “irreversible sequelae” and a “major handicap”, but did not settle the “ethical dilemma” of the continuation of treatment. She also warned about the difficulty of assessing the pain felt by the baby, if he was kept alive.
