When last September, the Minister of Social Affairs and Health, Marisol Touraine, published the decree establishing group action in health to “allow victims of accidents linked to health products to defend themselves collectively before the courts “, the victims of the anti-epileptic Depakine had announced that they intended to launch this type of action against the Sanofi laboratory.
That’s done. Apesac (the association to help parents of children suffering from anticonvulsant syndrome) has filed a class action before the Paris tribunal de grande instance, in order to have the laboratory recognized the responsibility for the disorders of which their children suffer, born under Dépakine.
Sanofi has four months to recognize its responsibility
The group action is in addition to a series of procedures already launched by the victims of this anti-epileptic drug: around twenty civil procedures, criminal proceedings and a procedure before the administrative court against the drug agency ANSM, therefore against the State, for “lack of information”.
The Sanofi laboratory has received the assignment from the association. He has four months to recognize his responsibilities or not. Then, it will be justice, which will decide on the prosecution.
