Since the introduction of the health pass and the withdrawal of the obligation to wear a mask outside, it is difficult to see clearly when and where it is compulsory to wear it. Here is what the law says.
- The general rule is that wearing a mask indoors is not compulsory if this place requires a health pass at the entrance, except for transport.
- This rule varies according to the territory and the establishments, making the mask compulsory in almost all cultural places.
- In schools, the mask is only required in the departments most affected by the epidemic.
Since the beginning of the health crisis, the mask has been invited into our lives in order to limit the spread of the virus. Depending on the intensity of the circulation of the virus, the rules concerning the wearing of a mask have constantly evolved. Since the establishment of the health pass, the vagueness seems even more present. Overview of what the law says about the places and times when it is possible to get rid of the mask and those where it must be worn.
In fact, wearing a mask is required almost everywhere
The general rule is that wearing a mask indoors is not compulsory if this place requires a health pass at the entrance. “The mask is not compulsory only for people who have accessed the establishments by means of a health pass (establishment, place, service or event subject to it) with the exception of transport subject to the health pass where the wearing of a mask remains compulsory”, stipulate the law. Transport is therefore the only places where wearing a mask is compulsory, regardless of whether or not the health pass is claimed.
Another condition is added: this rule varies according to the territory and the establishments. “The mask may be made compulsory for anyone over the age of 11 (including for people with a health pass), either by the prefect of the department when local circumstances justify it, or by the person in charge of the place or the organizer of the event”, is it written in the legislative text. In fact, this provision means that wearing a mask remains compulsory in a majority of places, however subject to the obligation to present your health pass. As such, the majority of cultural places such as theatres, cinemas or museums require the wearing of a mask.
Schools, a special case
Schools are special cases. The government’s choice on this subject is to territorialize the measures. Thus, the mask is no longer required in the departments least affected by the epidemic. To find out if your department is concerned, the government keeps an up-to-date map of France. The departments colored in green are at level 1 of the protocol (incidence rate of 50 per 100,000 inhabitants for 5 consecutive days), and are therefore no longer concerned by the obligation to wear a mask among children in primary school.
