Accused of fighting against compensation for victims, Servier claims to keep its commitments. 11 files out of the 1,540 opinions were rejected, indicates the laboratory.
At the end of August, thirty doctors, philosophers and committed personalities reminded the Servier laboratory and the medical profession of their legal and moral obligations. In this manifesto already signed by 7,000 people, they reproached the industrialist in particular for declaring in front of the microphones wanting to compensate the victims of the drug Mediator, but to lead in parallel “a legal guerrilla war which despairs the patients, some of whom are dying”.
Remained silent until now, Olivier Laureau, President of Servier, responded on Monday to the attacks in a ” Open letter to the signatories of the Manifesto of 30 “.
Servier rejected 11 compensation cases
“We are not trying to delay the (compensation) process,” says Olivier Laureau first of all. Words supported by figures published on the same day on the laboratory website and updated to August 31, 2015.
In these infographics, we can read “that at present, for only 11 files (out of 1,540), ONIAM considered that Servier’s position was not fully satisfactory and announced that it was using the mechanism. substitution provided for by law to guarantee compensation for patients ”.
A way to escape for Servier? Not at all, according to the industrialist, who explains, “that in no case has he refused to make an offer”.
“For your information, the 11 replacement agreements considered by ONIAM are: 7 cases because they had previously received a final rejection notice from ONIAM (1), and 4 cases in the absence of expertise medical device to assess the damage ”, writes Olivier Laureau.
ONIAM obliged to replace
Contacted last week by Why actor, Erik Rance, director of ONIAM, confirmed these figures. “In this case, ONIAM has the obligation to replace Servier. We do this and we then go to court against Servier to recover the sums, these may be accompanied by a penalty of 30%. A “sudden” change in policy that began last spring, he said.
For the rest, the Servier laboratory indicates that out of the 8,800 patient compensation claims submitted to ONIAM, 5,701 have been studied to date by the board of experts of the Office (i.e. 64.8%), and Servier’s liability was called into question for 1,942 requests (34.1%).
So far, the laboratory has made 1,282 compensation offers to patients, of which 753 have been accepted by patients (58.8%), 485 are awaiting a response from patients (37.8 %), and 44 were refused by the victims (3.4%), who can then contact ONIAM.
37 patients have already done so, but for 26 of these requests, ONIAM refused to take the place, considering Servier’s offer as “in accordance with the opinion given”.
