The senators adopted, as part of the vote on the Finance Bill, the amendment initiated by the RoseUp association (in collaboration with Les Séropotes), aimed at promoting the creation of a new type of borrower insurance contract “inclusive”, that is to say without a prior health questionnaire. The RoseUp association, which defends, supports and informs women affected by breast cancer, intends to “restore equity in the face of the loan”.
5 years after the adoption of the law on the right to be forgotten (1), which paved the way for better insurability of former cancer patients by allowing them to no longer declare their pathology between 5 and 10 years after the end of treatment, RoseUp wants to go further. “This new project aims to fight against the deregulation of the borrower insurance market which is at the expense of the most vulnerable people”, explain the activists. “The “inclusive” insurance contract (without medical selection) seeks to stop the escalation of hyper-selection which distorts the very principle of pooling by placing on the sickest and oldest the financial burden of a price of constantly calling downward. Call price from which only the youngest and healthiest benefit”, they add.
A tax advantage?
These insurance contracts taken out as collateral for a professional loan or for the acquisition of a principal residence would benefit from a tax advantage (reduced TSCA rate) in order to encourage all market players to offer them.
“They would thus offer solutions to as many people as possible and would facilitate access to insurance for many loan applicants who are subject to refusal, exclusion of guarantees and very significant additional premiums for health reasons”, concludes the Rose up association. Each year, nearly 59,000 French women learn that they have developed breast cancer and more than 12,100 die of it. Detected at an early stage of development, this disease has a survival rate of more than 87%.
