The decision of the Administrative Court of Appeal of Nancy fell: the Reims hospital is invited to resume the procedure for stopping care on Vincent Lambert.
It is a new twist in this family affair that the judges provoked following a seizure of the nephew of Vincent Lambert. This Thursday, May 26, 2016, the public rapporteur of the Administrative Court of Appeal of Nancy recommended that the expert consultation procedure that could lead to the cessation of care resume on this patient in a vegetative state for more than seven years. She was suspended in July 2015 after the CHU medical team said she had been pressured.
Final decision on June 16
At the time, it was a victory for the parents of the patient who wanted to see their son kept alive at the end of this family council. This first decision to stop treatment, which they contested, should however have been implemented after having been validated by the European Court of Human Rights (ECHR) on June 5, 2015.
To justify his choice, the public rapporteur of Nancy indicated “ that there will never be any serenity in this affair ”. He therefore ordered Dr Daniela Simon, in charge of Vincent Lambert, to “resume the collegial procedure within one month” after reading the judgment. The Administrative Court of Appeal put its judgment under advisement on June 16.
Whatever its decision, an appeal to the Council of State, not suspensive, will remain possible. “If the court follows the advice of the public rapporteur, which is often the case, the hospital will have to go to the end of the collegial procedure and make a new decision, ”concluded Me Bruno Lorit, lawyer for François Lambert.
