The back surgeon practicing in the Grenoble region, accused of several dozen cases of medical errors with serious consequences and suspended by decision of the Order of Doctors, filed a complaint against four of his patients for defamation.
“If my client engages in these procedures with a vengeance, it is because with a vengeance we are dragging him through the mud!”. It is with these words that Me Bernard Boulloud, the lawyer for the back surgeon in the Grenoble region, accused by dozens of patients (including nearly 60 cases identified by Health Insurance) of medical errors with severe consequences – the relatives of a man who died in 2017 even accuse the practitioner of being responsible for the death – explained the decision of his client, Dr. V., to file a complaint in turn on May 10 against four of his patients for defamation .
Suspended since May 1
The doctor was suspended in January 2019 for three years, including 18 months suspended by the Council of the Order, suspension taking effect on May 1. The CNOM accuses him of having repeatedly decided to operate “without having all the necessary elements” and of having provided “no convincing explanation” in more than thirty cases of postoperative complications.
The Council of State seized against the sanction of the CNOM
His lawyer denounces since this suspension “a media lynching of incredible violence”. He seized the Council of State against the sanction decided by the National Council of the Order of Doctors and denounced before the Council of the Order of Isère a doctor from the Primary Health Insurance Fund whose investigation is at the origin of the suspension of the surgeon by accusing him of seeking to “discredit” this one.
