The manifesto of the 30 brings together doctors, philosophers and personalities committed to reminding the Servier laboratory of their legal and moral obligations. Because for them “if the representatives of the SERVIER laboratory declare in front of the microphones that they want to compensate the victims of the Mediator drug, their lawyers are engaged in a legal guerrilla war which despairs the patients, some of whom are dying”.
Out of 8,800 patient compensation claims lodged with the National Medical Accident Compensation Office (Oniam), 5,701 claims were examined by experts from the Office and Servier’s liability was called into question for 1942 , according to figures updated as of August 31 on the site of the Servier laboratory.
Olivier Laureau recalls that “a specific text of law governs, under the aegis of ONIAM, the practical modalities and deadlines of this compensation route. We are not trying to delay the process ”.
“To date, for only 11 cases, ONIAM has considered that Servier’s position was not fully satisfactory and has announced that it will use the substitution mechanism provided for by law to guarantee compensation for patients”, explains the Minister. President. “In no case has Servier refused to make an offer.

– 7 cases because they had previously received a final rejection notice from ONIAM,
– 4 cases in the absence of medical expertise to assess the damage ”.
The Mediator case
Used by five million people in France, the Pick is the cause of heart valve lesions and could be responsible for 2,100 deaths in the long term. The Mediator victim compensation system was put in place in 2011 and started very slowly, before gaining momentum last year. In 2014, 86% of the files examined concerning a pathology potentially linked to the Mediator resulted in positive compensation notices.
The drug was prescribed for about thirty years, first to prevent excess fat in the blood, and then for overweight diabetics. It has also been misused for its appetite suppressant properties.
