During the presentation of the third cancer plan 2014-2019, François Hollande had promised the right to be forgotten for patients. A promise that should be kept with an amendment to the health bill.
The right to be forgotten will allow former patients to no longer declare their former illness to banks or insurance companies in order to contract a loan. The abolition of the double penalty for the sick “is a Copernican revolution, explains Bernard Spitz, president of the French Insurance Association to AFP. Childhood cancers
Bernard Spitz explained that this device would be articulated around 3 pillars. First of all, all childhood cancers will be affected by the right to be forgotten as well as certain adult cancers, depending on their type and from a certain number of years after the end of treatment. Finally, scientific advances will also be incorporated into decision-making. “We are going to start from a maximum period. Then, we will be able to refine the deadlines according to the cancers, thanks to the data that we will have at our disposal, ”he explained.
The modalities of the right to be forgotten are discussed this Tuesday during two meetings bringing together the actors who have signed the S agreement.‘insure and borrow with an aggravated Aeras health risk.
Aeras Convention
Until now, before borrowing, bankers in the vast majority of cases required contractors to take out insurance. However, insurance companies asked borrowers to declare whether they had suffered from a serious illness. According to this information, they could fix a price increase or an exclusion of guarantees.
In 2007, to put an end to the exclusion of formerly sick people, the Aeras agreement was signed. It makes it easier to benefit from insurance in order to obtain a mortgage or credit without having to complete a medical questionnaire.
However, to benefit from it, certain conditions are necessary. As part of a mortgage loan, the borrower must be less than 70 years old at the time of repayment and borrow a maximum amount of 320,000 euros.
Regarding consumer loans, the subscriber must be under the age of 50, the credit period must be less than or equal to 4 years, the cumulative amount of credit must not exceed 17,000 euros. A declaration on honor commits the borrower to respect this ceiling.
In 2013, nearly 15% of loan insurance requests presented an aggravated health risk, ie nearly 443,000 requests. In 97% of cases, insurers accepted files under the Aeras agreement.
