300 Argentines carrying fraudulent PIP breast implants have filed a complaint with the courts of their country. They are claiming 41 billion euros in damages.
They are 300 and determined to fight in court! They claim to be Argentinian victims of Jean-Claude Mas, the French manufacturer of PIP breast prostheses containing a fraudulent silicone gel. These women have just filed a complaint before the courts of their country against the French company PIP, the German certification body TÜV and the German insurer Allianz. And their demand is enough to give the companies concerned a cold sweat.
According to Me Virginia Luna, one of the victims’ lawyers, the amount claimed by the latter for damages would be 41 billion euros. But it doesn’t end there. At a press conference in Buenos Aires, the lawyer accompanied by three victims has already announced that this amount will increase further. Indeed, if the collective complaint were accepted, it could lead to the compensation of 15,000 people, the estimated number of women concerned in Argentina. As a reminder, PIP prostheses were distributed in more than 65 countries, half of which in South America.
So, to justify these exorbitant compensation claims, Me Virginia Luna explains, “that it is no longer an aesthetic question but a real health problem”, emphasizing that the replacement of a prosthesis fraudulent PIP cost in Argentina from 20,000 to 25,000 pesos, or 2,700 / 3,350 euros.
Regarding France, the number of women with PIP breast prostheses is estimated at around 30,000. At present, more than 16,000 of these women have already had these prostheses removed, according to the latest assessment drawn up at the end of May by the National Drug Safety Agency. These victims will however have to wait until December 10 to know the fate of Jean-Claude Mas. This is the date set by the Marseille Criminal Court to deliver its judgment.
