A patient victim of a medical error obtained compensation for his damage thanks to the administrative court of Nantes.

He has just obtained 187,963 euros… The Nantes administrative court has decided to reassess the compensation for a patient who suffered a medical error. For the judges, the damage suffered is both aesthetic, sexual and professional. Today he is 47 years old but the story goes back more than 10 years.
Bladder and prostate removal…
In June 2011, the patient was 36 years old. At the time, according to Actu.fr, he notices blood in his urine and decides to go to the hospital in Quimper, in Finistère. The doctors gave him a neuroscan. At the sight of the results, they believe that he is suffering from a tumor in the bladder. They prescribed three chemotherapy sessions and decided a few months later, in December of the same year, to carry out a major operation: the removal of the patient’s bladder and prostate.
…due to a misdiagnosis
But it would seem that the doctors made a diagnostic error… In any case, this is the opinion of those who subsequently took charge of the patient, in a Parisian hospital. Indeed, the analysis of the samples called into question the diagnosis of cancer established in Quimper. In reality, he would have suffered from a very rare form of bladder pecoma… A disease so rare that only five cases are known in the scientific literature.
In reality, the patient was suffering from a benign disease
Subsequently, the patient moved to Nancy, where the CHU continued his care. In October 2014, the health professionals of this establishment considered that the pathology from which he suffered was not serious… And that it should not have led to the removal of the bladder and the prostate.
Repair the damage suffered by justice
But no turning back is possible with this type of intervention… And the consequences suffered on his personal and professional life cannot be medically repaired: he no longer works and suffers from erectile dysfunction and urinary leakage. Faced with this injustice, he therefore decided to go to court. Initially, he claimed compensation of 815,336 euros. On June 4, 2020, the Rennes administrative court ordered the establishment to pay 183,213 euros to the patient and 60,398 euros to the Primary Health Insurance Fund. Last November, the Administrative Court of Appeal of Nantes changed this: the compensation for the patient was reassessed at 187,963 euros.
