From October 1, it will be forbidden to vape in the workplace. On the other hand, if it welcomes the public, employees will be able to continue to use their e-cigarettes.
Vaping while working will no longer be possible from the 1ster next october. Well, not for everyone. According to a decree published this week in Official newspaper, electronic cigarettes are prohibited “in closed and covered workplaces for collective use” but not “open to the public”.
Some explanations are in order. The text bans the electronic cigarette in the open spaces of companies, rest and nap rooms, or even dining rooms. Company canteens outside the building are also targeted by this ban. Obviously, shooting your vapoteuse in the toilets, in the elevator and in the corridors is prohibited. Just like cigarettes, for that matter.
In these companies, visible signage reminding the ban on vaping must be put in place. Recalcitrant employers will be liable to a fine of up to 450 euros. On the side of vapers refusing to go outside with the stream of smokers, they could pay a fine of up to 150 euros.
In addition, the text clearly specifies that the use of e-cigarettes is prohibited “in schools and establishments intended for the reception, training and accommodation of minors”, but also “in the means public transport closed ”. It is therefore impossible to use it in the courtyard, and even less in a classroom, but also in the bus, the tram, the train and station halls, the plane and the boat.
Attention to the internal regulations
On the other hand, customers and employees working in places open to the public can still use their electronic cigarettes. This is particularly the case of bartenders, waiters or in-store salespeople. As well as the caregivers in the hospital, or the employees of the administration (town hall, prefecture, health insurance fund….).
However, if the internal regulations of these different places formally prohibit the use of e-cigarettes, the decree does not apply. It is in fact the internal regulations that prevail. In this case, employees and consumers do not have the right to light their vapoteuse.
