Marion Larat, the first Frenchwoman to file a complaint after a stroke attributed to a 3G pill, released a book. His lawyer says hundreds of other complaints could follow.
“The pill is bitter”, in this testimonial book released this Wednesday, Marion Larat tells of her ordeal that became a fight. On December 14, 2012, the 25-year-old woman, victim of a stroke, filed a complaint. Now 65% disabled, Marion Larat accuses the 3rd generation pill of having caused the stroke at the origin of her disability. In this first complaint, his lawyer, Me Jean-Christophe Coubris, targeted the Bayer laboratory and the director general of the National Medicines Agency (ANSM) for “unintentional interference with the integrity of the human person” and for non-compliance with the precautionary principle. “Marion Larat is not alone in her battle. Many other female victims join us every day ”, confides Jean-Christophe Coubris contacted by why actor.
600 victim files in the process of being put together
To date, the Bordeaux lawyer for Marion Larat claims to have filed more than 80 complaints with the Public Prosecutor. The case is for the moment still at the stage of the preliminary investigation and the civil parties are waiting to see if the magistrate in charge of the public action decides or not to send these complaints to the investigation. If this is the case, Me Coubris declares that he still has 200 pending complaints which will most certainly be filed if the investigation is opened.
Finally, the latter also acknowledges receiving new spontaneous testimonies from victims every day. As such, 600 other files of women victims of a pulmonary embolism or of a stroke, attributable according to them to the last generation pills, would be in the course of constitution within his cabinet.
Prescribing doctors spared, but until when?
Interviewed in January 2013 by why actor, Me Coubris was considering taking legal action against prescribing doctors. For him, some of them would have prescribed a last generation pill in 1st intention, whereas it was advisable not to do it. “A lack of information and a prescription that is not suited to the situation,” he said. From a legal point of view, the lawyer put forward as a reason “a lack of information to the patient. I would even say that there is also a prescription defect since they had the recommendation not to prescribe this pill there in first intention. “
On this specific point, Me Coubris wants to give himself time. And specifies that for the moment, these complaints concern only six laboratories and the general director of the Ansm.
Finally, still on the prescriptions, the lawyer admits, however, to be satisfied with the awareness of prescribing doctors. “Our battle is bearing fruit. Mentalities are changing. A new vision of contraception is emerging, ”he concludes.
Indeed, according to the latest figures from the Agency, in August 2013, the drop in sales of pills of 3th and 4th generation was 52.4% compared to August 2012, and at the same time the sales of those of 1st and 2thgeneration increased by 32.2%. Sales of implants and IUDs have increased by 26% since December 2012.
