Twelve year old with a foreign body in the spine
A woman in her sixties operated in January 2006 at the Caen University Hospital for a runny nose, had a drainage system fitted with a catheter. Unfortunately, the tube, 20 cm long, has been forgotten in his lumbar spine (part of the spine), according to daily information West France.
For twelve years, she therefore lived with this foreign body in her, without knowing it. This lack of information and the psychological consequences that resulted from it led the patient to seek compensation from this hospital. And she won.
The CHU ordered to compensate the complainant up to 4,000 euros
In fact, at first instance, the administrative court of Caen had ordered the CHU to pay the complainant, now in her sixties, the sum of 4,000 euros. The patient claimed 32,000 euros.
May’s beginning, the Nantes administrative court of appeal followed this decision, considering that ” the organic origin of psychological disorders is not established “. The CHU is condemned to compensate the complainant, but up to 4,000 euros.
