It’s the end of a long battle for a young disabled woman and her parents. In 1998, she suffered a medical error when she was born. The nursing staff at the maternity hospital in Remiremont, in the Vosges, where she was born, had not detected that she was in pain during childbirth.
The consequences of this error are heavy for the young girl, who is seriously handicapped. It is for this damage that the maternity hospital was ordered to pay nearly 11 million euros in compensation.
More financial freedom
Academic, aesthetic or even sexual harm, suffering… All aspects of the consequences of medical error have been studied.
“These are compensation, it will not change our lives, nevertheless recalls the mother of the young woman in Vosges morning. You will always have to be at her side 24 hours a day. Even today, I use a baby monitor to be able to hear her in the event of a problem. I didn’t win anything, it’s just compensation. My daughter is in a wheelchair. “
“It’s for her siblings,” she continues. If something happens to me, I don’t want them to be responsible for their sister. Above all, this procedure ensures that its future does not depend on them. “
The allowance, paid from next January, will indeed ensure the medical care and daily care of the young woman.
Substantial compensation
The compensation paid is close to records in the event of a medical error. In 2014, an equivalent sum was granted to the family of Philippe Giardina, in similar circumstances. At birth, an error in judgment on the part of the obstetrician had caused a serious handicap.
“This is one of the most favorable decisions taken by an administrative tribunal in this kind of case,” said the family lawyer, Me Isabelle Tetaz-Monthoux. The right to compensation had already been granted in 2004, but the case dragged on pending final medical conclusions allowing the amount of compensation to be fixed.
The management of the maternity unit has so far not wished to react.
