The list of indictments
While the 1st Servier trial is due to resume on May 21, the list of indictments continues to grow. Jacques Servier, the founder of the laboratories, was indicted in December for deception and fraud but also for homicides and unintentional injuries. Other senior executives followed: Christian Bazantay, general secretary of the group, was indicted in February for “complicity in the offense of illegal participation of a civil servant in a previously controlled company”. On the side of the Medicines and Health Products Safety Agency (ANSM), two former employees were indicted in February: Jean-Michel Alexandre, who was chairman of the marketing authorization commission in Ministry of Health from 1985 to 1993, then director of drug evaluation at the Medicines Agency from 1993 to 2000; as well as Eric Abadie, director of evaluation at Afssaps from 2007. In mid-March, Dominique Maraninchi suffered the same fate. He was indicted for homicides and unintentional injuries, as the legal representative of the ANSM.
Judicial information and trials in the plural
On the other hand, no minister is for the moment worried by justice. A complaint filed by an alleged victim of Mediator targeted four former ministers: Philippe Douste-Blazy, Bernard Kouchner, Jean-François Mattei and Xavier Bertrand. The complaint was closed by the Court of Justice of the Republic, considering that they “had not been warned of the risks of the Mediator before the alert was given at the end of 2009”. In addition, several judicial inquiries are in progress, for influence peddling, for deception and fraud, and for “involuntary homicides and injuries”. Finally, two trials must be held: one at the Paris Criminal Court, and the other at the Nanterre Criminal Court on May 21. In December 2012, the Court of Cassation ruled out grouping together the ongoing legal proceedings concerning the Mediator case.
