Dr Jean-Michel Cohen is contesting the verdict of the disciplinary chamber of the Order in the European courts banning him from practicing medicine for one year.
The Council of State confirmed on March 15 the verdict of the disciplinary chamber of the Order of Physicians (CNOM) prohibiting Dr. Jean-Michel Cohen from practicing medicine for two years – one of which was suspended. But one of the most famous nutritionists in France decided to respond on Monday.
In a press release sent to Agence France Presse (AFP), he announced that he had taken note of this decision, which sanctioned “an alleged advertising approach on my part, through a website providing advice on prevention and weight loss”.
A “legal vagueness”
For the practitioner, this decision illustrates the “legal vagueness” that exists as to the possibility for doctors to use modern communication technologies. In this case, it is indeed his activity on a paid coaching site intended to lose weight that is in question.
Managed by the company Anxa, the site gives 10% of its profits to the nutritionist. The latter effectively participates in the program since he writes a daily newsletter, sent to subscribers, and his face is omnipresent on the site.
Dr Cohen seizes Europe
Except that for the doctor, “the Internet site in question is only the continuation on Internet” of its activity of author of tens of books which never posed any problem.
Faced with this treatment that he does not understand, Dr Jean-Michel Cohen has decided to challenge this decision before the European Court of Human Rights (ECHR).
