The new law on influencers has definitely been adopted by the National Assembly and the Senate. Much of its content relates to health.

Laxative tea, pills to tighten the vaginal walls, slimming tights… While influencers could until now sell anything and everything on their social networks, a new French law will now regulate the promotion of many products or acts related to health.
Prohibition of the promotion of “health acts”
The text thus formalizes the prohibition of the promotion “acts of health, medicine, cosmetic surgery and therapeutic abstention”, as well as “products containing nicotine”, such as electronic cigarettes and puffs.
It is also no longer possible to promote products that miraculously promise, for example, to cure cancer, diabetes or lose weight.
In order to limit the spread of the mental disorder called “dysmorphophobia”influencers will now also have “the obligation to mention on videos and photos when they are retouched, and if the representations of a silhouette or a face are produced by artificial intelligence”.
Finally, to fight against addictions, it is no longer allowed to advertise gambling on platforms that do not allow minors to be excluded.
Two years imprisonment and 300,000 euros fine
Even influencers who live in Dubai are targeted, as the text frames anyone speaking to a French audience. In the event of non-compliance with this new law, the penalty is two years’ imprisonment and a fine of 300,000 euros.
“With this bill adopted unanimously, France is the first European country and one of the first countries in the world to propose a complete regulatory framework for the commercial influence sector”, concludes the Ministry of the Economy in a press release.
